Rental Agreement

After booking you declare that you have entered into the following rental agreement with regard to the holiday home in municipality AYEN, GRASCHAMP, number 12 located in FRANCE.

Only intended for holiday accommodation without boarding house, to be occupied by a maximum of 6 people. Tenant declares to be aware of the fact that:

  • A stay week lasts from 3 pm on Saturday to 10 am on Saturday morning.
  • You must bring your own bed linen, bath towels, kitchen towels and tea towels.
  • There are 3 double beds (180 x 20 cm) with separate mattresses and a French bed (140 x 200 cm) with 1 mattress. Each mattress comes with a single duvet and pillow. There is also a children's bed available.
  • Final cleaning is provided by FermePostel and is mandatory
  • Pets are not allowed due to hygiene.
  • The house is halfway up a hill. There are a number of stairs in and around the house. The location is therefore not suitable for disabled people.
  • To prevent clogging of the septic tank, we kindly but urgently request that you do not put any other material (such as sanitary towels or tampons) in the toilet outside of toilet paper.

Article 1 | Legal responsibility of FermePostel

FermePostel cannot be held responsible for any disruption, change or prevention of the customer's stay, if this is the result of unforeseen or insurmountable events beyond his control. FermePostel cannot be held responsible for inconveniences caused by the work of third parties, such as municipality, province, etc. Nor can FermePostel be held responsible for interruption of water or electricity, if this is the result lack of sun hours and / or lack of rainfall. FermePostel disclaims any responsibility for loss, theft or damage to luggage, personal property or vehicle, as well as for costs resulting from a delay in reaching the holiday home or apartment.

Article 2 | Reservation and price

A reservation is valid from the moment that FermePostel has received the required down payment. Paying for this means that the tenant has taken note of and agrees with the general rental conditions mentioned here and the full description of the property that he has rented. The prices of FermePostel are calculated in EUROs and are per property per week or other period, if stated on the invoice. VAT is not applicable here. Costs of meals, drinks, etc. are never included in the price. Additional costs, such as final cleaning, consumption costs, etc. are stated in the property description and are never included in the price, unless stated otherwise.

Article 3 | Payment of the rent

For each reservation 1/3 of the rent must be paid. This deposit must be received by FermePostel within 14 days of the invoice date. The remainder must have been received by FermePostel no later than 6 weeks before the start of the stay in the holiday home. If this has not taken place, the tenant will receive a letter with the request to pay the remainder within 5 working days. If this does not happen, this will be seen as a cancellation of the property by the tenant and the cancellation conditions of Article 4 apply. FermePostel then also has the right to resubmit the relevant holiday home for rent. If the reservation is made less than 6 weeks before the start of the rental period, payment of the full rent must be made per return. After receiving the remainder of the rental price, you will receive a confirmation by email from FermePostel.

Article 4 | Cancellation by the tenant

Any cancellation must be notified in writing to FermePostel. FermePostel charges the following amounts, depending on the date of cancellation by the tenant:

  • cancellation more than 3 months before the start of the rental period: 10 euros.
  • cancellation between the 90th and 60th day before the start of the rental period: 25% of the rent.
  • cancellation between the 59th and 30th day before the start of the rental period: 50% of the rent.
  • cancellation less than 30 days before the start of the rental period: 100% of the rent.

If the tenant does not use the holiday home or leaves it before the end of the rental period, no refund will be made.

Article 5 | Cancellation by FermePostel

If, due to unforeseen circumstances, FermePostel has to cancel a lease, the tenant will be notified immediately and refunds will be made. If the cancellation of the lease is not the result of force majeure, then FermePostel will also pay an additional amount of 20% of the rent, being the usual compensation for damage and inconvenience.

Article 6 | Complaints and disputes

No complaint will be processed if it is not reported by telephone within 48 hours of taking possession of the holiday home and is followed by a registered letter. The same rule applies if something serious occurs during the stay in the holiday home. If the tenant refuses to take possession of the holiday home, because the condition of the home does not correspond to what he can reasonably expect from it, he must immediately contact to record with FermePostel. If it is not possible to reach an agreement, he must have the complaint checked by an expert, a bailiff or a civil-law notary in order to obtain an objective judgment. The current contract has been drawn up and must be interpreted under Dutch law. All disputes that could arise from this contract fall under the exclusive jurisdiction of the Dutch cantonal court.

Article 7 | Description

All loose-leaf information or information on the website of FermePostel concerning the holiday home, the layout, the furniture or the relevant facilities is provided in good faith, based on data from the owner or as a result of on-the-spot checks by FermePostel. If a change takes place between the time of reservation and the start of the rental period, FermePostel will inform the tenant about this, but then FermePostel cannot be held responsible for this. If, in spite of everything, the information regarding the holiday home, the layout, the furniture, the maximum number of residents or the relevant facilities turns out to be incorrect, then the tenant must immediately inform FermePostel of this, so that he can do all this. to recover. All information regarding tourism and sporting activities is provided by third parties and is not the responsibility of FermePostel.

Article 8 | Arrival and departure

The arrival in a holiday home normally takes place between 3 and 8 p.m., unless otherwise agreed. It is recommended that you contact the person who arranges the reception by telephone the evening before departure in order to arrange a precise time and place and to call again if the appointment has to be changed due to unforeseen circumstances. If this procedure is not followed, FermePostel cannot be held responsible for not being able to take possession of the property when the tenant arrives on site. The holiday home must be vacated no later than 10 am on the day of departure.

Article 9 | Maximum number of residents

No more than 6 people are allowed to stay in a holiday home, unless FermePostel has given permission in advance. If this number is exceeded, the person arranging the reception can deny access to the holiday home to these extra persons. If at a later date, without the knowledge of the person who arranges the reception, extra people nevertheless come to stay in the house, a claim of 25% of the rent per extra person will immediately arise, which, if necessary, will be withheld on the guarantee.

Article 10 | Pets

It is not allowed to bring a pet in the home.

Article 11 | Guarantee

FermePostel does not use a deposit.

Article 12 | Additional costs

FermePostel charges an amount for the mandatory final cleaning. The use of fire retention (if necessary), water and electricity is included in the rent. The tourist tax is borne by the landlord and is therefore included in the rent.

Article 13 | Cleaning

The house must be found clean and tidy. If this is not the case, this must be reported immediately to the person who arranges the reception, so that he or she can rectify this. Moreover, the tenant must report this to FermePostel within 24 hours. FermePostel must be left in good condition when your stay ends. This means that the floors are clean; the dishes (washer) is clean and all dishes are placed back in the cupboards. In addition, the tenant himself must dispose of all household waste including glassware and empty bottles. Please do not leave perishable food.
